Plan B is an IRS approved Capital Gains Tax Deferal strategy called an Installment Sale Trust or IST.  Not only are Capital Gains deferrable but gets even better since the funds can be reinvested in real estate at any time in the future, all while still deferring the Capital Gains Taxes!!

This IST Tax Deferral Strategy can also be used by long time primary residence homeowners that have built up more than $500,000 in equity.  A married couple selling their Primary Residence currently has a $500,000 Capital Gains Tax exemption on the first $500,000 in equity but any additional equity above $500,000 is typically subject to Federal and State Capital Gains Taxes upon sale of the property.

Not all 1031 Exchange accomodaters are created equal and offer or allow 1031 Exchange sellers to have a Plan B.  For many years only very large corporations and high net worth business and asset owners that paid for high cost tax accountants were aware of and could afford the IST strategy due the high CPA, Legal and Administrative costs.
